Employers' Obligations Regarding the Employment of Persons with Disabilities – Changes from 2025

Starting January 1, 2025, employers with at least 50 employees will have stricter obligations regarding the integration of persons with disabilities, according to Emergency Ordinance (OUG) 127/2024.

Main Obligations:

✅ Hiring at least 4% of employees with disabilities from the total workforce.✅ If they do not hire, they have two alternatives:

  • Full payment of the monthly contribution to the state budget.
  • Payment of at least 50% of the contribution, with the remainder required to be used for purchases from protected units.

✅ For job vacancies:

  • Obligation to contact at least three specialized NGOs and report the process to ANPDPD and ANOFM.

✅ Annual reporting by January 31, including:

  • A list of positions occupied by persons with disabilities.
  • An inventory of the skills required for employment.

What if there are no job vacancies?

❌ There is no longer an obligation to contact NGOs, but the contribution payment remains mandatory.

Conclusions:

  • Employers must make genuine efforts to integrate persons with disabilities.
  • Reporting is mandatory, and failure to comply may result in penalties.
  • Purchases from protected units can reduce the due contribution.
