1. No obligations for employers regarding the recruitment of persons with disabilities (from January 2025)
According to Emergency Ordinance no. 127/2024, employers with at least 50 employees will have the following obligations:
A. Collaboration with NGOs
- Submitting a written request to non-governmental organizations that includes:
- The responsibilities of vacant positions;
- The necessary qualifications;
- The work norm.
B. Evidence for authorities
- Documents attesting the submission of the written request to NGOs;
- Presentation of these documents to:
- The National Authority for the Protection of the Rights of Persons with Disabilities;
- The National Employment Agency.
C. Annual reporting
- Submitting, by January 31, a report to authorities containing:
- The situation of positions held by persons with disabilities;
- The skills required for vacant positions.
2. Amendments and completions in the RO e-Transport System (Emergency Ordinance no. 129/2024)
A. Temporary suspension of penalties
- Until March 31, 2025, penalties for non-compliance regarding the transmission of vehicle positioning data are suspended.
B. Gradual confiscation and proportional penalties
- Violations will be penalized as follows:
- First violation: application of a fine;
- Repeated violations: progressive confiscation of undeclared goods, up to 100% of their value.
- Exceptions:
- For goods with high fiscal risk, penalties can be avoided if the data are subsequently recorded in supporting documents and accounting.
C. Flexibility in data modification
- Economic operators can update data on goods until the 25th of the month following the completion of transport, even if the UIT code deadline has expired.
D. Registry of penalties
- Creating a centralized electronic registry for:
- Monitoring imposed penalties;
- Ensuring their correct and gradual application.
